Class Action Over 40m Credit Card Theft

Barely is the ink dry on press releases about the loss of data on 40 million credit card holders, than a class action has been launched.

Rothken Law Firm, from Rafael California has launched action against Cardsystems Solutions alleging a failure to maintain adequate data security, leading to the security breach.

The suit filed in San Francisco further alleges that CardSolutions broke Visa and MasterCards "Data Security Standards". These prohibit storing certain kinds of confidential consumer information.

The lawsuit alleges that Cardsystems Solutions, Merrick Bank, Visa and MasterCard have violated their duty to timely and properly inform consumers of the nature and degree of the alleged security breach.

Californian law is strict in cases of security breaches. People potentially affected have to be notified, if they are Californian citizens.
